NSW Government to simplify rezoning process following feedback from discussion paper

NSW Government is simplifying the rezoning process by introducing new measures that aim to speed up the planning system and subsequently create new jobs, homes and open spaces.

A new approach to rezonings in NSW

The Planning Reform Action Plan is a series of initiatives that aim to improve inefficiencies in the planning system. As part of this Plan, NSW Government is aiming to cut down proposal times for rezoning, including reducing processing times to a third by 2023 and establishing an appeals pathway for strategic rezoning.

Following on from the discussion paper that NSW Government exhibited between December 2021 and February 2022, several proposals have been put forward to simplify and overcome delays within the rezoning process:

  • simplify process and minimise duplication
  • create more certainty and consistency
  • improve transparency and trust
  • improve the quality of proposals
  • reduce processing timeframes
  • empower councils to make decisions on matters important to their local communities
  • allow the NSW Government to deal with matters where government intervention is beneficial
  • recognise private proponents in the process and giving recourse opportunities

The introduction of these changes in 2022 is expected to support jobs, homes and open spaces.

Feedback from the discussion paper will help guide long term opportunities identified in the new Local Environmental Plan Making Guideline. The discussion paper also aligns with the council expectations that the Minister for Planning and Public Spaces outlined in the Environmental Planning and Assessment (Statement of Expectations) Order 2021 (Order).
